1. Service Description
ColdPitch ("we", "us", or "our") is an AI-powered cold email generator available at cohesionos.polsia.app and operated by CohesionOS. The platform allows users to generate personalized cold outreach emails using artificial intelligence. By accessing or using ColdPitch, you agree to be bound by these Terms of Service.
2. Acceptable Use
You agree to use ColdPitch only for lawful purposes. You must not:
- Use the service to send unsolicited bulk email (spam) in violation of applicable law, including the CAN-SPAM Act or GDPR.
- Generate content that is harassing, defamatory, discriminatory, or otherwise harmful.
- Attempt to reverse-engineer, scrape, or abuse the service's APIs or infrastructure.
- Resell or sublicense access to the service without written permission from CohesionOS.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
We reserve the right to suspend or terminate accounts that violate these terms without notice.
3. Payment Terms
ColdPitch offers credit-based and subscription (Pro) plans. Credits are consumed upon each email generation request. Used credits are non-refundable. Unused credits may be refunded within 14 days of purchase at our discretion; please contact support@coldpitch.ai.
Pro plan subscriptions are billed monthly or annually. You may cancel at any time; cancellation takes effect at the end of the current billing period and you will retain access until that date. We do not prorate refunds for partial periods.
Prices are subject to change with 30 days' notice to your registered email address.
4. Intellectual Property
You retain full ownership of all content you input into ColdPitch and all email copy generated for you through the service. CohesionOS does not claim any intellectual property rights over your generated content. We may use aggregated, anonymized usage data to improve the service.
The ColdPitch name, logo, and underlying software are the intellectual property of CohesionOS and may not be used without prior written consent.
5. Disclaimer of Warranties
ColdPitch is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that generated content will achieve any particular result. Use of AI-generated content is at your own discretion and risk.
6. Limitation of Liability
To the maximum extent permitted by law, CohesionOS and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 90 days preceding the claim.
7. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the service after changes constitutes your acceptance of the updated Terms.
